# Preamble

The original author of this license, hereby licensed under itself, not being
by any mean an expert in legalese, a lot of this license was inspired from
external sources.

Most relevant such sources were:
* the GNU General Public License 3.0, published by the Free Software Foundation
* the Lambda License, written by Akarys/Ambre Bertucci

Many forms of phrasings may be borrowed from these sources, especially regarding
legal implication or knowledge of applicable copyright agreements.

Additionally, this license was mostly written with software licensing in mind,
but with an effort to keep it as detached from it as possible in order to make
it available to more forms of licensable work.

# 0. Foreword

The Nerjal's Limited License (NLL) is an open license, meant to clarify the
author's intents and expectations with their work.
It may not comply to the definition of a "Free Open Source Software" (FOSS),
as it opens room for deliberate restrictions over otherwise permissions the
author does not wish to provide to everyone.

This license is built on the idea that standard FOSS licenses leave too much
lee-way for third parties to exploit creators freely by having their work shared
in a way they might not agree with or that is detrimental to their own business.
Hence, this license seeks giving extensive control over artifacts and
capabilities to the authors, while supporting an available source community,
allowing it to easily be shared and modified.

To make it short, you may share or modify the source as you wish, as long as the
resulting work remains under this license, links back to the original (used)
source, and you both: state your changes (via a version control system or
through a detailed rundown of any made modifications), and keep the original
author(s) listed as owner of the used source. This also allows you to propose
contributions to the original source, leaving their approval to the author's
discretion.

Making use of a modified version of the product, regardless of circumstances,
will have you required to make your source available to anyone that may
interact with it.

In order to share a resulting product (e.g. sharing binaries compiled from a
such licensed source), extra rules are applicable, according to the author's
preference. Such restrictions may include: monetization limitations, product
distribution, rebranding, and more.

Such restrictions will have to be explicitly provided by the author, and must
be respected through any custom modification. In other words, if you make your
own modified version of the licensed source, you must apply all restrictions

The precise terms and conditions for the licensed product and source follow.

#1. Definitions.

"The License" refers to this license, the version 1 of Nerjal's Limited License.

"The Source" refers to any of the base, unprocessed and copyrightable work under
this license.

"The Product" refers to the processed result of the source, e.g. a compiled
software binary.

To "modify" a work means to copy from or adapt all or part of the work in a
fashion requiring copyright permission, other than the making of an exact copy.
Any result of such action is called a "modified version" or "modified result" of
the earlier work, or a work "based on" the earlier source.

"The Author(s)" refers to the owner(s) of the source. Extends to any owner of
parent source if regarding a copy of a previous source.
"Copyright Holder(s)" refers to the author(s), and anyone holding ownership
rights over the source.

"You" refers to you, the licensee, the reader of this license, user of the
product, etc; an individual or legal entity exercising rights under this
license.

To "propagate" a work means to do anything with it that, without permission,
would make you directly or secondarily liable for copyright infringement, except
private use or execution of a copy. This includes copying, distribution (with or
without modification), and possibly more based on applicable law.

To "interact" with a licensed work refers to any form of exposition to its
source or product, including but not limited to remote, partial and indirect
exposition or usage of the licensed work or its features.

# 2. Legal protection of the author's rights

No licensed work shall be considered part of an effective technological measure
under applicable law fulfilling obligations as per the 11th article of the WIPO
copyright treaty of the 20th of December 1996, or any law prohibiting or
restricting circumvention of such measures.

When you convey a covered work, you waive any legal power to forbid
circumvention of technological measures to the extent such circumvention is
effected by exercising rights under this License with respect to the covered
work, and you disclaim any intention to limit operation or modification of the
work as a means of enforcing, against the work’s users, your or third parties’
legal rights to forbid circumvention of technological measures.

# 3. The Source

# 3.0.1 The source does not include any work produced by anyone else than the
authors. Third party dependencies of the licensed work may be subject to another
license, but such license must permit any applied form of inclusion.

# 3.0.2 The "used source" or "upstream" for a source copy is the very source it
was derived from, and a source will be the used source of any copy of itself.
Each must allow getting back all the way to the original source at all time.

# 3.0.3 Any propagation of the source must abide to author-specified
restrictions.

# 3.1 Modifications

# 3.1.1 You must not modify the licensing of the licenced work in any form of
propagation.

# 3.1.2 You must not remove the previous copyright holder names from a
modification, but are free to add your own by specifying your contribution to
your modification.

# 3.1.2.1 Upon submitting your modification for contribution to the used source,
its own author may not refuse your mention as a copyright notice for your own
modifications, but is free to specify what your contribution brought to the
product.

# 3.1.2.2 Your name being added as a copyright mention of the used source does
not give you ownership rights over the licensed used source.

# 3.1.3 Any contribution to a used/parent source is final, and you cannot demand
the removal of the licensed work from the parent source after it being accepted
in said parent source.

# 3.1.4 You must detail all changes you bring to the used source in a place
accessible by all people interacting with your propagation.

# 3.1.5 You must not remove mention of the used source's authors; such mention
must remain clear throughout your propagation. The usage of a means to track
changes history (e.g. version control softwares) does not account as explicit
mention of the authors.

# 4. Product and source usages

# 4.1 Educational and research purposes

All source, both original and propagated, must remain available for educational
or research purposes within the scope of the people interacting with it.
This does not strictly allow propagation for such purposes, but fair use of
all or parts of the licensed work could be replicated as need be for such ends.
It remains up to you and the authors to discuss what would befall such fair use
within the context of author-imposed restrictions.

# 4.2 Commercial use

You must not make commercial use of the source or product itself without
explicit agreement from the author. You can however, without any restriction
specifying otherwise, make commercial use of a personal work depending on that
source, as long as such work sums to at least as much source material as the
relevant source or product usage.

The author may also impose profit distribution restriction, but you may
negotiate the terms of profit distribution with the author if they have not
set restrictions against it. However, if no other restriction forbids
commercial use and the authors fails to answer a mail or email communication
explicitly indicating a will to negotiate such distribution without proper
justification (e.g. email falling into spams, failure to deliver a physical
mail) within 30 business day after reception, then base distribution
restrictions must be applied.

Any written request made within 180 calendar days upon receiving a negative
answer is considered implicitly rejected.
Any written request pending answer at the time of receiving a negative answer
is considered implicitly rejected unless explicitly proven otherwise.

Any restriction changes over commercial use must be applied, or taken into
consideration over a renegotiation of profit distribution, but cannot be
retroactively applied over past gains from a commercial use of the licensed
work.

# 4.3 Private use

You may, as an individual, make use the source or product at your own discretion
in a private environment for non-profit endeavours, but may not distribute it
beyond its initial commercial distribution status.
Everyone interacting with a private use of the licensed work must be informed
of its origin and any potential changes made for your private propagation.

# 4.4 Product and source usage

4.4.1 You may make use of the license work free of charge within the bounds of
the author's distribution and imposed restrictions.

4.4.2 Any usage of the licensed work outside of these bounds requires written
approval of all copyright holders. Such authorisation shall be free of charge,
global, non-transferable, and revocable at all time by any author or copyright
holder upon written notice to you.

4.4.3 Authors are free to impose additional clauses to such usages as long as
they remain within the bounds established by 4.4.2

4.4.4 Any paid authorisation of usage must be a globally available distribution
formula, available to any individual desiring so. Authors can restrict access
to such distribution to other legal entities at their discretion.

# 5. Restrictions

Authors must make any applied restrictions explicitly known at all time,
including those inherited from parent sources.

Restrictions shall not be written within the license itself.

Authors must make sure you can easily find the effective restrictions at all
time, through a main project description or an explicitly labeled attached note
for instance.

Restrictions must only cover legally applicable terms and conditions the author
would be able to enforce through an all-rights-reserved license.

# 6. Disclaimer

THE PRODUCT IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE
AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER
LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM,
OUT OF, OR IN CONNECTION WITH THE PRODUCT OR THE USE OR OTHER DEALINGS IN THE
PRODUCT.

In case of a conflict between the section #0 ("Foreword") and any other section,
the latter section shall prevail.
